  • Actually Richard was correct in Australia we have no separation of church and state.

    I know that a reading of s116 of the Constitution would seem to indicate that this may be the case- for it was most likely based on a similar section in the US constitution. The difference lies in interpretations by our respective judiciaries. The Amercian courts determined that the concept of sepaeration of church and state is intended in the constitution, whereas our courts have determined that we only have no established state religion, hence religious schools receive abundant funding from the state, whereas in the states this is unconstitutional and by some "miracle" church schools survive without state funding.

  • AVN's application (Trade Mark : 1331856) in Class 44 ("Information services relating to health care; providing information, including online, about hygienic and beauty care for human beings or animals; provision of information relating to nutrition; provision of information relating to vaccination") is currently under examination.

    The TM app was lodged in November 2009 - so they had some money then.

    No objections have been lodged to date.

    Is there anyone around here with some IP law knowledge who can run interference?

  • I have an idea: If the AVN does actually go out of business, what are the chances that a consortium of Australian Skeptics could take the name and rebrand it as a real Australian Vaccination Network, giving factual information to those who are looking into vaccination issues.

    I don't know what the legal or financial issues might be to take over an abandoned trademark, but it might be something to look into.
